A lawyer representing a man charged with first-degree murder in the death of an off-duty Mississippi Highway Patrol trooper wants to see toxicology reports on people involved in the incident.
Attorney Jamie Franks of Tupelo represents Troy Anthony Eaton of Rienzi, who is charged with first-degree murder in the shooting of off-duty trooper Josh Smith, 32, of Alcorn County, on Sept. 30. The incident occurred in Big Hatchie Bottom, a rural area near the Alcorn/Tippah County line.
Now that Eaton has been indicted, Franks will seek the evidence the state has in the case. Franks said he wants to see toxicology reports on his client as well as Smith. He hopes more light can be shed on the situation.
He also wants to see a toxicology report on Ricky Dale Vick of Michigan City, whom Eaton is accused of non-fatally shooting. Eaton is charged with the attempted murder of Vick.
Franks said he feels his client has a strong case. Witnesses support the claim that Eaton was defending himself when the incident occurred, according to Eaton’s attorneys.
Franks said he is anxious to see what evidence the state has in the case so he can determine how to proceed.
Eaton remains out of jail on a $300,000 bond and has pleaded not guilty. The case could go to trial as early as September, Franks added.
