Trooper’s employment records, toxicology reports and other documents sought by suspect’s lawyers

Attorneys for the suspect in the fatal shooting of an off-duty Mississippi Highway Patrol trooper said five subpoenas will be issued Thursday.

Subpoenas will be directed to Tippah County Coroner Chris McCallister, Mississippi Attorney General Jim Hood, Tippah County E-911 Coordinator Mary Joe Hudson, the Corinth Municipal Court clerk and the Alcorn County Justice Court clerk, according to the attorneys, Bill Wheeler and Jamie Franks of Tupelo.
The attorneys represent Troy Anthony Eaton, 43, of Rienzi, who is charged with capital murder in the shooting of off-duty MHP Trooper Josh Smith, 32, of Alcorn County.
The subpoenas will seek information on Smith, such as toxicology reports, employment records, 911 calls and many other documents. (Full subpoenas below).
Wheeler and Franks told Corinth Today last week that there are a “multitude of witnesses” who support the claim that Eaton was exercising his legal right to self defense when Smith was fatally shot Sept. 30 in Tippah County’s Big Hatchie Bottom.
But the court affidavit says Smith was acting in his official capacity when Eaton allegedly killed him. It also alleges that Eaton “knew” that Smith was acting in an official capacity as an MHP trooper at the time of the shooting.
